Paperless (e-Docs) Disclosures and Consent

I agree that Value Based Brands LLC d/b/a Express Energy (hereafter Express Energy) may provide me with any Communications in electronic format, to the extent allowed by law, and that it may discontinue sending paper Communications to me. “Communication(s)" means any contract or plan documents, including but not limited to, the Terms of Service document (“TOSA”), Electricity Facts Label (“EFL”) or Your Rights as a Customer document, and any documentation of enrollment or any amendments thereto, invoices, disclosures, notices, responses to claims, transaction history, privacy policies and all other information related to the product(s) or service(s) Express Energy provides. I understand that all Communications provided in electronic format will either be provided (1) via e-mail, (2) by access to a web site that is designated in an e-mail notice send to me at my designated e-mail address at the time the information is available, (3) to the extent permissible by law, by access to a web site that is generally designated in advance for such purpose, or (4) by requesting I download a PDF file containing the Communication. I also understand and agree that all Communications in electronic format will be considered to be in "writing," and will be deemed to have been received by me no later than three (3) federal business days after Express Energy sends the Communication to me via e-mail or after Express Energy sends an e-mail notice that the Communication has been posted via one of the methods specified above. My consent to receive Communications electronically is valid until I revoke the consent by notifying Express Energy and such revocation will be effective only after Express Energy has had a reasonable period to process my request.

I understand that if I revoke my consent to receive Communications electronically, this may affect my eligibility for this plan or for certain other product(s) or service(s) of Express Energy and may subject me to certain fees specified in my contract or plan documents. I also understand that it is my responsibility to provide Express Energy with true, accurate and complete e-mail addresses, contact and other information and to maintain and update promptly any changes in this information by notifying Express Energy. Express Energy shall treat my provision of an invalid e-mail address or any subsequent problems of delivery to a previously valid e-mail address as a withdrawal of my consent to receive electronic Communications and, as specified in my contract or plan documents, I understand I may be subject to certain fees.

In order to complete this enrollment and receive my Communications electronically, I acknowledge that I have, at a minimum, access to a personal computer or other device capable of accessing the internet, an internet web browser that supports 128 bit encryption, software that permits me to receive and access PDF files, a valid e-mail account that I can access, and sufficient storage space to save past Communications or a printer to print them.

I understand that Express Energy will not send me a paper copy of any Communication unless I request it or Express Energy deems it appropriate to do so. Express Energy reserves the right, but assumes no obligation, to provide a paper (instead of electronic) copy of any Communication that I have authorized it to provide electronically. I understand that I may obtain a paper copy of an electronic Communication by printing a copy of any electronic Communications and retaining it for my records or by contacting Express Energy to request that it mail me a paper copy. I understand that I may be subject to a fee for copies of electronic Communications subject to the terms of my contract or plan documents.

I understand that Express Energy reserves the right to terminate or change the terms and conditions on which it provides electronic Communications and will provide notice thereof in accordance with applicable law. I ACKNOWLEDGE AND AGREE THAT MY CONSENT TO ELECTRONIC COMMUNICATIONS IS SUBJECT TO THE ELECTRONIC SIGNATURES IN GLOBAL AND NATIONAL COMMERCE ACT, AND THAT I AND EXPRESS ENERGY BOTH INTEND TO VALIDATE THE ABILITY TO CONDUCT BUSINESS BY ELECTRONIC MEANS.
